Terms of Service

These Terms of Service ("Terms") govern your use of the Roadity app, roadity.com, related content, connected vehicle features, and support services (collectively, the "Service"). The Service is provided by Inteligent Studio Incorporated ("Roadity," "we," "us," or "our"). Contact us at support@roadity.com for service, subscription, or legal questions.

By affirmatively accepting these Terms, creating an account, or using the Service after these Terms have been presented to you with reasonable notice, you agree to them to the extent permitted by applicable law. If you do not agree, do not use the Service. The Privacy Policy explains personal-information handling; agreement to these Terms is not consent to every form of data processing.

1. Eligibility and accounts

You must be at least 16 years old to use Roadity. If you are below the age of majority where you live, you must have a parent or legal guardian review these Terms and authorize your use and any purchase to the extent required by law. You must meet all licensing, supervision, insurance, and other legal requirements before driving. Having access to Roadity does not establish that you are legally permitted or qualified to drive.

You may use available guest features or sign in through supported providers. Give accurate information, secure your account and device, and tell us promptly about suspected unauthorized access. You are responsible for activity you authorize, subject to applicable law. A guest account, local progress, or purchase association may be difficult to recover after clearing data, changing devices, or losing access. Use supported account-linking and purchase-restoration features where available.

2. Educational purpose and independence

Roadity provides educational material and sample practice routes. We are an independent provider and are not affiliated with, endorsed by, or acting for DriveTest, Serco, Ontario's Ministry of Transportation, another licensing authority, or a driving school merely because it is listed. Government names and third-party trademarks identify their respective services.

Practice routes are examples, not official, guaranteed, or leaked examination routes. Examiners may select different roads, manoeuvres, and requirements. We do not guarantee a test appointment, passing result, licence, improved score, or particular level of driving skill. Roadity does not replace qualified instruction, the official driver's handbook, current law, or an examiner's lawful directions. Check official sources for current fees, eligibility, procedures, and requirements.

3. Safe driving and navigation

You are responsible for operating the vehicle safely and lawfully at all times. Set up the route and audio before moving. Do not read, type, change settings, or otherwise interact with a handheld device while driving. Stop in a safe, lawful place before making changes. A passenger may assist only where lawful and without distracting the driver.

Actual road signs, traffic controls, conditions, and directions from authorized persons take priority over the app. Maps, positioning, speed-limit data, route instructions, and audio may be inaccurate, incomplete, delayed, or unavailable. Never follow an instruction that would be unsafe, illegal, enter restricted property, or conflict with your licence conditions. Observe posted speed limits and use your own judgment; displayed speeds and limits are not certified instruments or legal authority.

CarPlay or other supported vehicle integrations do not make every interaction safe or lawful. GPS, battery, internet access, device compatibility, background permissions, and third-party outages can affect guidance. Roadity is not an emergency, collision-avoidance, autonomous-driving, or vehicle-control system. Do not rely on it for emergency assistance.

4. Licence and permitted use

Subject to these Terms and the rights supplied with your purchase, we grant you a limited, non-exclusive, personal, non-transferable licence to access the Service and use its content for your own lawful learning and practice on supported devices. Store usage rules, including any applicable family-sharing rights, remain applicable. You receive a licence, not ownership of the app or its content.

Do not resell or redistribute content, share access commercially, scrape or bulk-download route data, bypass payment or access controls, interfere with security, introduce malware, impersonate another person, or use the Service to harass or violate others' rights. Do not reverse engineer the software except where applicable law expressly permits it. These restrictions do not limit statutory rights, open-source licence rights, accessibility rights, or uses expressly authorized by us in writing.

We and our licensors retain rights in the software, design, text, maps, route compilations, audio, and branding, subject to third-party rights. Keep attribution and copyright notices intact. Contact us to request permission for commercial, instructional, or other use beyond this licence.

5. Free features, paid access, and plan scope

Some features are free; others require a subscription or another entitlement. The purchase screen identifies the applicable product, price, currency, billing interval, trial or introductory offer, and included access. A plan may cover selected test centres or routes rather than all Roadity content. Review the selected coverage before confirming. An app download alone does not purchase paid access.

Availability can depend on device, operating system, region, app version, and plan. The purchase disclosures and store confirmation govern the specific commercial details of your order. Keep the store receipt and a copy of these Terms. A promotion applies only on its stated conditions and does not promise future offers.

6. Apple App Store and Google Play subscriptions

Auto-renewing subscriptions continue and charge for each billing period until cancelled through the store that billed you. Your Apple Account or Google Play payment method is charged according to the price, period, and terms displayed at checkout. Applicable taxes and currency are determined by the store's purchase disclosures. A trial or discounted period, if offered, converts to the disclosed paid renewal unless cancelled in time. We do not promise a trial for every user.

Apple purchases

Payment is charged to your Apple Account at purchase confirmation, subject to any disclosed trial. Unless the offer or applicable law provides otherwise, cancel renewal at least 24 hours before the current period ends; renewal may be charged within the 24 hours before that period ends. Manage or cancel through Settings → your name → Subscriptions → Roadity. For a free or discounted trial, follow Apple's cancellation deadline, including cancelling at least 24 hours before the trial ends to avoid renewal. An unused portion of a free trial may be forfeited when you purchase a subscription, where applicable. See Apple's cancellation instructions.

Google Play purchases

Google Play charges at the start of each billing cycle under the offer you accept. Cancel before the next renewal through Google Play → profile → Payments & subscriptions → Subscriptions → Roadity, or Google Play subscriptions. Follow the dates and conditions shown for your plan or trial. We do not impose Apple's 24-hour rule on Google Play purchases. See Google Play's cancellation instructions.

Cancellation, changes, and restoration

After cancellation, access ordinarily continues through the paid period, subject to store rules for trials, refunds, revocations, and billing issues. Uninstalling Roadity, logging out, deleting an account, or ceasing to use the app does not cancel a store subscription. Cancel separately with the store. Passing your test or no longer needing the app does not automatically stop renewal.

Price changes apply prospectively and follow the notice and consent requirements of the store and applicable law. You may cancel before a changed renewal takes effect. Upgrades, downgrades, billing-date changes, credits, grace periods, and failed-payment handling follow the offer and store rules. Paid access may end if the payment expires, is refunded or revoked, or cannot be verified; contact us if a verification error blocks a valid purchase.

Use Restore Purchases where available with the same store account used to buy, and sign into the relevant Roadity account. RevenueCat helps validate and synchronize entitlements. Restoration does not create a new purchase or guarantee transfer between store accounts or platforms. Contact support before purchasing again if access is missing or duplicated.

7. Refunds and statutory cancellation rights

Refund eligibility depends on applicable law, the offer, and the billing store's policies. Cancelling future renewal does not itself refund a completed charge. Apple purchase refund requests can be submitted through Apple's Report a Problem service. For Google Play purchases, use Google Play's refund process or contact us with your order details for assistance. Do not send full card details or passwords.

Nothing here makes purchases unconditionally non-refundable or excludes a statutory remedy. Canadian provincial consumer laws may provide cancellation, reimbursement, warranty, disclosure, or other rights that apply regardless of store policy or these Terms. Contact us to exercise any right against Inteligent Studio Incorporated; you are not required to rely solely on a store's discretionary refund process.

8. External services and content

Apple, Google, RevenueCat, map providers, video hosts, and other services help deliver Roadity. Their applicable account, store, map, and service terms govern your direct use of their services. Linked websites, school listings, embedded videos, and third-party information are not promises about availability, quality, endorsement, or suitability. Your dealings with a driving school or other independent provider are with that provider. Our obligations under consumer and privacy law remain unaffected.

Map and directions data are subject to their displayed provider attributions and applicable terms, including Google Maps terms. Do not remove those notices or reuse provider content beyond the permissions granted. Your carrier may charge for data, and you are responsible for those separate charges.

9. Feedback and submissions

You retain ownership of information and material you submit. You grant us permission to store, reproduce, and use submissions only as reasonably needed to provide support, investigate reported problems, operate and improve the Service, and meet legal obligations, consistently with our Privacy Policy. Sending feedback does not authorize publication of your name, image, or personal testimonial for marketing without separate permission.

Submit only material you have the right to provide. Do not include unlawful content, confidential information belonging to others, or unnecessary sensitive personal information. Suggestions may be used to improve Roadity without an obligation to pay for the idea, but this does not transfer your personal-information rights.

10. Updates, availability, suspension, and termination

We may update software and content to improve the Service, correct errors, maintain security, or respond to legal and provider changes. You may need a supported device and current app version. We do not promise uninterrupted availability or permanent access to a particular free feature.

We may restrict access where reasonably necessary to address a material breach, fraud, a security threat, or legal requirements. Where practical and lawful, we will give notice and an opportunity to resolve the issue. You may stop using the Service at any time and request account deletion through our deletion process. Store renewal must be cancelled separately.

If we discontinue a paid service or materially reduce purchased access during a prepaid period, we will provide the notice and remedies required by law and the purchase agreement, including an appropriate refund where owed. Termination does not erase accrued rights, payment disputes, privacy rights, or statutory remedies. Clauses about intellectual property, accrued payment obligations, permitted liability limits, disputes, and other provisions that logically need to continue survive termination.

11. Warranties and responsibility

We will provide the Service with the care and obligations required by applicable law. To the extent the law permits, the Service is supplied on an “as available” basis without additional promises that it will be error-free, meet every personal objective, or produce a particular test result. Content and navigation limitations are described above. These qualifications do not exclude mandatory legal warranties, required service quality, or liability that cannot lawfully be excluded.

12. Limits of liability

Only to the extent permitted by applicable law, we are not responsible for indirect or consequential losses, lost profits, or loss of opportunities arising from use of the Service, and our aggregate liability arising from the Service is limited to the greater of CAD $100 and the amount you paid for Roadity in the 12 months before the event giving rise to the claim.

These exclusions and limits do not apply where prohibited by law, including to mandatory consumer remedies, fraud, intentional misconduct, gross negligence, or death or personal injury where liability cannot be limited. For Québec consumers, they do not exclude liability for our own acts where prohibited by the Consumer Protection Act, bodily or moral injury, or intentional or gross fault. No provision requires you to waive a right or remedy that cannot legally be waived. Roadity remains responsible for its own conduct as required by law.

13. Canadian law and resolving disputes

Subject to mandatory laws applicable where you reside, these Terms are governed by Ontario law and the federal laws of Canada applicable there. Courts in Ontario have non-exclusive jurisdiction. You retain any right to bring a claim in your home province or another competent forum, including a small-claims court, and the benefit of mandatory consumer protections of that jurisdiction.

Contact support@roadity.com with a description of a dispute so we can try to resolve it. Contacting us first is not a condition of exercising a legal right or meeting a legal deadline. These Terms do not require arbitration or waive participation in a class proceeding. You may contact consumer-protection or privacy authorities directly.

For Québec residents, applicable Québec consumer, privacy, civil-law, and French-language rights prevail over conflicting terms. Nothing here is an agreement to waive French-language protections or a declaration that you have chosen English where a French version must first be provided.

14. Apple application licence

For an app obtained through Apple's App Store, Apple's Standard Licensed Application End User License Agreement applies to the application licence unless a separate custom EULA is supplied through the App Store. These Terms govern Roadity's services and do not purport to replace the store's applicable application licence. Where that licence or mandatory store usage rules conflict on an application-licensing matter, those rules prevail, subject to mandatory consumer law. Inteligent Studio Incorporated provides Roadity support; Apple does not become the provider of Roadity's educational or support services by distributing the app.

15. Changes and general provisions

We will post updated Terms with an updated date and give reasonable advance notice of material changes through the app, website, or an available contact channel, except where a more immediate change is necessary for legal or security reasons. Changes will operate prospectively. We will obtain acceptance where required by law; mere publication will not override a requirement for notice or consent. If you disagree, you may stop using the Service and cancel renewal, without losing rights relating to an existing purchase.

These Terms, the specific purchase disclosures, and any applicable application licence form the agreement for the subjects they address. If a provision is unenforceable, the rest remains effective to the extent legally possible. A failure to enforce a provision is not a waiver. You may not transfer your contractual access except as allowed by law or applicable store rules. We may transfer the agreement as part of a lawful business transfer, subject to required notice and without reducing your mandatory rights. Privacy obligations continue as described in the Privacy Policy.
